We recommend this because should the content of any server associated with our system undergo legal processing, you are fully responsible for any and all of the content of the server in question, as well as any backups created therin. As stated in our Terms of Service, "By using our services, you agree that you are fully responsible for any and all content, including any files, of each server associated with your account. We are not, at any time, to be held responsible in any way, shape, or form for the content of the servers we secure, nor for the content of the backup(s) generated therein." Under the demand of a subpeona or other legally warranting documentation, we will supply any and all information to the proper authorities as they so request provided they have relevant and just cause. Cause is only deemed relevant if the account in question has had any ties to SiBa Systems. Just cause includes: piracy, copyright infringement, malicious software (i.e., viruses), illegal sexual websites (i.e., pedophilic websites condoning child sexuality). We reserve the right to deny disclosure of any and all information of an account to legal authorities until such position is proven and cause is determined. Information included in a legal disclosure includes, but is not limited to: logged IP addresses from access, server information, server mirrors, and any logged activities that have occurred for the account in question. SiBa Systems will not, under any circumstance, disclose any access-controlled information (usernames or passwords) associated with our system). SiBa Systems reserves the right to withold notification to a client or reseller that an account is under legal interrogation or has received any legally binding demands. SiBa Systems will not, under any circumstance grant access to a server to anyone of any stature, regardless of rank or position. SiBa Systems will not, under any circumstance, access the contents of any backups stored on our system; however, SiBa Systems will submit any backups on file to the proper authorities upon request provided they have relevant and just cause.
